In the last 12 months, the UK ICO has for the first time exercised its power to issue multi-million pound fines under the GDPR (to British Airways, Marriott and Ticketmaster), as well as exercising its wider enforcement powers. Moreover, the long awaited Supreme Court hearing in the case of Lloyd v Google took place at the end of April 2021, which, when the judgment lands, will have wide ranging implications on the extent to which damages for ‘loss of control’ of data become recoverable and how widely representative actions (sometimes referred to as ‘class actions’) become a feature of UK data protection law going forward.
With this as backdrop, this presentation will discuss the issues around fines, sanctions and liability that businesses and others should be aware of. |
